TrialSIte News, LLC (aka TrialSite Media) is a Salt Lake City, Utah-based LLC. The company owns both the TrialSite News online news as well as TrialSite Connect and offers various news and information services (“Services“).

This service is open and free to everyone with a focus on research. It is a moderated network meaning that behavior is governed by a set of community rules that are based on standard common sense decency and respect for all in the community. What is not tolerated are the following: hate speech, any ethnic, racial or gender bias or discriminatory language of any time; over political or religious bias and discrimination nor inappropriate behavior that would be deemed unacceptable in any professional social network.TrialSite Connect does include a moderation tool that is employed to ensure behavior doesn’t violate these terms. TrialSite Connect does not collect personnel data for commercial purposes. As the social network evolves, TrialSite Connect may seek to develop value-added services to make the experience more productive; to help those that seek to connect for business opportunities in clinical research; to connect those individuals seeking certain kinds of clinical trials to connect with other researchers, providers or companies that may have more information about specific clinical research initiatives.
TrialSiteConnect registered users (Members) may share their professional identities and credentials, display academic accomplishments, engage and collaborate with their TrialSite Connect networks, share knowledge and insights, post and view others’ content, and discover business and career opportunities.Patient or patient advocates can search for provider networks that may offer research trials that may help with a certain health condition. Research centers may use TrialSite Connect to build networks of community members, patients, and partners.
Some content within TrialSiteConnect may be visible to those not registered or logged out members also known as Visitors. A User may be a Member or a Visitor.
TrialSite Connect Community Moderation
TrialSite Connect Users can flag prohibited postings and use they find by reporting to the moderator
Any hate speech, racial or ethnic bias, gender harassment, elderly bias and any items that fall under U.S. Title VII of the Civil Rights Act of 1964
No political speech, political organizing or any political-related activity
No offers for any illegal activity whatsoever
No marketing of prescription drugs, medical devices, controlled substances, and related items
No marketing of drugs, alcohol or other substances
No false, misleading, deceptive or fraudulent content; bait and switch, keyword spam
No offensive, obscene, defamatory, threatening or malicious postings or any form of communication
No posting of anyone’s personal identifying, confidential or proprietary information unless the individual User seeks to share their own information. They cannot share others information.
This social network operates under the laws of the United States and the State of Utah; nothing that breaks any laws in either jurisdiction is allowed in TrialSite Connect.

For this first version of TrialSite Connect, the company will not process data for any commercial objectives.From time to time TrialSIte Connect may seek to inform specific Members about specific and relevant news and information that may be of interest to them based on expressed preferences and an opt-in or express request for information.In TrialSite Connect, unlike today’s most popular social networks, members’ data, including health data, is not processed for commercial purposes.
The Site will be monitored (but not censored) for inappropriate behavior online. As was mentioned previously, inappropriate behavior includes any cyberbullying, cyberstalking, bias, and prejudice of any kind and generally hateful or harassing communications.TrialSite Connect encourages Members to inform us when another Member is breaking this policy. Upon any breaches of the good behavior policy will lead to one warning to that Member. If the incident happens a second time the Member will be removed from the TrialSite Connect system.
TrialSiteConnect is committed to complying with federal and state laws in the United States as well as any rules elsewhere including any updated or “enhanced” EU-US Privacy Shield Framework that results from the recent Court of Justice of the European Union ruling. That being said if Users register and are part of this social network it is there responsibility to understand the data protection and privacy laws of their specific jurisdiction.TrialSite Connect operates under the laws of the United States of America and the State of Utah.
Unless licensed by us in a separate written or electronic agreement, you agree not to use or provide software (except our App and general purpose web browsers and email clients) or services that interact or interoperate with TrialSite Connect, e.g. for downloading, uploading, creating/accessing/using an account, posting, flagging, emailing, searching, or mobile use. You agree not to copy/collect TrialSite Connect content via robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent (e.g., by hand). Misleading, unsolicited, and/or unlawful postings/communications/accounts are prohibited, as is buying or selling accounts. You agree not to post content that is prohibited by any of TrialSite Connect policies or rules referenced above (“Prohibited Content”). You agree not to abuse TrialSite Connect flagging or reporting processes. You agree not to collect TrialSite Connect user information or interfere with TrialSite Connect. You agree we may moderate TrialSIte Connect access/use in our sole discretion, e.g., by blocking, filtering, re-categorizing, re-ranking, deleting, delaying, holding, omitting, verifying, or terminating your access/license/account. You agree (1) not to bypass said moderation, (2) we are not liable for moderating or not moderating, and (3) nothing we say or do waives our right to moderate, or not. Unless licensed by us in a separate written or electronic agreement, you agree not to (I) rent, lease, sell, publish, distribute, license, sublicense, assign, transfer, or otherwise make available TrialSite Connect or our application programming interface (“API”), (ii) copy, adapt, create derivative works of, decompile, reverse engineer, translate, localize, port or modify the App, the API, any website code, or any software used to provide TrialSite Connect, (iii) combine or integrate TrialSite Connect or the API with any software, technology, services, or materials not authorized by us, (iv) circumvent any functionality that controls access to or otherwise protects TrialSite Connect or the API, or (v) remove or alter any copyright, trademark or other proprietary rights notices. You agree not to use TrialSite Connect or the API in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.
Disclaimer & Liability
To the full extent permitted by law, TrialSite Connect and its officers, directors, employees, agents, licensors, affiliates, and successors in interest (TrialSite Connect Entities) (1) make no promise, warranties or representations as to TrialSite Connect, including completeness, accuracy, availability, timeliness, proprietary, security or reliability; (2) provide TrialSite Connect on an “AS IS” basis and “AS AVAILABLE” basis and any risk of using TrialSite Connect is assumed by use (the member or user); (3) disclaim all warranties, expressed or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from course of dealing, usage, or trade practice and (4) disclaim any liability or responsibility for acts, omissions, or conduct of you or any party in connection with TrialSite Connect.TrialSite Connect entities are NOT liable for any direct, indirect, consequential, incidental, special, punitive, or other losses, including lost profits, revenues, data, goodwill, etc. arising from or related to TrialSite Connect.
Claims & Indemnity
Any claim, cause of action, demand, or dispute arising from or related to TrialSite Connect (“Claims”) will be governed by the internal laws of Utah, without regard to conflict of law provisions, except to the extent governed by US federal law. Any Claims will be exclusively resolved by courts in Salt Lake City, UT (except we may seek preliminary or injunctive relief anywhere). You agree to (1) submit to the personal jurisdiction of courts in Salt Lake City, UT; (2) indemnify and hold TrialSite Connect Entities harmless from any Claims, losses, liability, or expenses (including attorneys’ fees) that arise from a third party and relate to your use of TrialSite Connect; and (3) be liable and responsible for any Claims we may have against your officers, directors, employees, agents, affiliates, or any other party, directly or indirectly, paid, directed or controlled by you, or acting for your benefit.
